Four Notifications regarding the New Civil Procedure Law accepted by the Turkish Grand National Assembly and entered in force as of the date of 1 October 2011 was published by the Ministry of Justice.
The Tariffs of the Court-Costs Advance Payment, the Expert Fee Advance Payment, the Witness Fee Advance Payment and the Arbitrator Fee Advance Payment of the Civil Procedure Law published at the Official Gazzette numbered 28070 and dated 30 September 2011 has entered in force as of the date of 1 October 2011.
A lawsuit in order for the obrogation of the Court-Cost Advance Payment Tariff which entered in force as of the date of 01.10.2011 was brought before the Council of State by the Istanbul Bar Association.
Upon the Decision of the Board of Directors of the Istanbul Bar Association, the lawsuit was filed in order for the obrogation and the issue of the stay order of the phrase “after the finalization of the judicial sentence” stated as “The unused part of the court-costs advance payment shall be returned to the plaintiff after the finalization of the judicial sentence” at the first sentence of the paragraph 1 of the 4th and 5th article of the Court- Costs Advance Payment Tariff of the Civil Procedure Law.

The Directive on Certificating of the Inheritance by the Notary Publics was published at the Official Gazzette as of the date of 4 October 2011.
It will be possible to ascertain whether the concerned applicant is legal inheritor or not according to the Directive published at the Official Gazzette as of the date of 4 October 2011 in consequence of the amendments brought by the Article 14 of the Law on Amendments on Several Laws in order for Acceleration of Judicial Services numbered 6217 and the supplemented articles 71/A, 71/B and 71/C to the Notary Law.
With the new regulation, in case that the concerned party is ascertained to be the legal inheritor, without applying to the Peace Court of Civil Jurisdiction the Certificate of Inheritance initiating the pourparties and the Copies will be able to be submitted by the notary publics considering the procedures regulated under the special laws.
The Directive on Inspecting and Monitoring of the Operations In the Scope of the License of the Generation and Distribution Companies Operating in the Electricity Market was published at the Official Gazzette.
It has been regulated under the Directive issued by EPDK and published at the Official Gazzette as of the date of 12 October 2011 that the Electricity Generation and Distribution Market shall be monitored by the special auditors certified by EPDK.
